These Terms of Service ("Terms") govern your use of upgradeelectricllc.com and any electrical services provided by upGrade electric LLC ("we", "us", "our"). By using our website or hiring us for work, you agree to these Terms.
1. About Us
upGrade electric LLC is a Colorado-licensed electrical contractor (Colorado Electrical Contractor License EC.0102546), insured for general liability, workers compensation, and commercial auto. We're based in Monument, Colorado and serve the Colorado Front Range — Monument, Palmer Lake, Colorado Springs, Larkspur, Black Forest, Falcon, Peyton, Fountain, and Air Force Academy.
2. Quotes and Estimates
Estimates from our online calculators (EV charger, panel upgrade, hot tub, etc.) are rough planning estimates based on the inputs you provide. They are not a binding quote. A binding quote is provided in writing only after a free on-site visit during which we measure, inspect, and confirm scope.
Once a binding quote is signed, the price is fixed for the scope it describes. If we discover existing code violations, hidden damage, or required changes during the work, we'll stop, document the issue, and present a written change order before continuing.
3. Scheduling and Arrival
We provide arrival windows, not exact times. We update you the morning of the appointment with a tighter window and call or text when we're en route. If we're unavoidably delayed, we let you know as soon as possible.
4. Pricing and Payment
- Most residential jobs are quoted as a flat price.
- Time-and-materials billing is used for emergency, diagnostic, and complex commercial work — disclosed up front.
- A deposit of 30–50% may be required before we order materials or schedule large jobs.
- The balance is due on completion of the job, before final inspection sign-off.
- We accept Visa, Mastercard, American Express, ACH bank transfer, and check.
- Past-due balances may accrue interest at 1.5% per month or the maximum allowed by Colorado law, whichever is lower.
5. Emergency After-Hours Rates
For emergency calls outside our regular hours (Mon-Fri 7:00 AM - 5:00 PM, Sat 8:00 AM - 12:00 PM), a flat after-hours service-call premium is disclosed before we dispatch — never as a surprise. The premium covers our drive-out and the first portion of on-site time; additional work is billed at our standard hourly rate.
6. Workmanship Warranty
We warrant the labor we perform on your property for one (1) year from the date of completion. If something we installed fails during normal use within that period, we return at no labor charge to repair or replace it. This warranty does not cover damage from misuse, manufacturer defects in materials we did not select, pre-existing wiring or fixtures we did not touch, or power surges, lightning strikes, utility outages, or acts of nature.
Manufacturer warranties on equipment (chargers, panels, fixtures) pass through to you. We help you file a claim if something covered fails.
7. Permits, Inspections, and Code Compliance
For any work that requires a permit under the Colorado adopted version of the National Electrical Code or your local jurisdiction, we pull the permit, schedule the inspection, meet the inspector on site, and obtain final sign-off. The permit fee is included in your quote. We do not perform permit-required work without a permit.
8. Customer Responsibilities
You agree to provide safe access to the work area (including pets secured), disclose known issues with the existing electrical system including prior DIY work, make decisions about fixture choice and scope within a reasonable time, and be present (or have an authorized adult present) for the initial walk-through and final walk-through.
9. Limitation of Liability
To the fullest extent permitted by Colorado law, our total liability for any claim arising out of or related to a job is limited to the price you paid for that job. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost income, lost data, loss of use, or property damage caused by failure of equipment we did not install. This limitation does not apply to liability for gross negligence, willful misconduct, or where prohibited by law.
10. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim arising out of (a) your breach of these Terms, (b) your violation of applicable law, or (c) inaccurate information you provided about the property or scope of work, except to the extent caused by our own gross negligence or willful misconduct.
11. Cancellations and Rescheduling
You can cancel or reschedule any non-emergency appointment at no charge with at least 24 hours notice. Same-day cancellations of confirmed appointments may incur a $75 trip-charge fee, waived if you reschedule within 7 days. Special-order materials already purchased on your behalf are non-refundable.
12. Force Majeure
Neither party is liable for delay or non-performance caused by events outside reasonable control, including severe weather, wildfire, utility power outages, supplier failure, government action, pandemic, strike, or natural disaster. We'll re-schedule as soon as practical.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. We'll first try to resolve any dispute informally — please contact us before filing a claim. If informal resolution fails, the dispute will be resolved in the state or federal courts located in El Paso County, Colorado, and both parties consent to that jurisdiction.
You and we waive the right to a jury trial except where Colorado law prohibits such a waiver.
14. Modifications
We may update these Terms from time to time. Changes apply to jobs quoted after the change is published. The "Last updated" date at the top of this page reflects the most recent change.
15. Severability
If any part of these Terms is held unenforceable, the rest remains in effect. The unenforceable part will be modified to the minimum extent necessary to make it enforceable.
